Terminology

'Client' means the person or persons, business or company that purchases a website from On-line Gaming Productions

'The Website' means the website or websites purchased by the Client in good faith.

'Domain name' means the domain name that is assigned to the Clients website for the duration of this agreement.

'Server' means the electronic capacity to store the Clients website, images and other related material on such an electronic device owned or operated by On-line Gaming Productions.

'Live website' means a clients website that has been paid for in full and has been published and launched on the World-wide web into the public domain.

'FTP' means File Transfer Protocol by means of suitable software for the purpose of uploading or downloading files to and from a server.

'Affiliate links' mean links prescribed and authorized by Casino Riches.

Terms of service

Server Access

All Clients will have privileges to FULLY ACCESS their OWN server via FTP. By utilizing simple HTML software either recommended by On-line Gaming Productions, or purchased separately by you the Client, will enable you to manipulate and add links and other facilities to your website. On-line Gaming Productions agrees to supply the facilities and software links that will allow the Client to control his/her website.

Clients who do not wish to take advantage of the above facilities, but nevertheless want to maximise the marketability of their website(s) by the virtue of our 'recommended affiliate links', Casino Riches will establish affiliate links on their behalf at the cost of £15.00 UK (or in equivalent currency) per affiliate link. This would include registration that will ensure the Client receives any resulting income, adding the banners and links to the Clients Gaming Page, and uploading the amended page(s) to the Clients server.

In order to retain these privileges you agree to the following conditions:

1. Your site will contain NO child pornography, bestiality, violence, torture, rape, warez or software pirating of any kind or your site will be deleted immediately.

2. You must not cheat topsites, links sites or any other sites or your account will be deleted.

3. You must have the rights to all material you publish on your website or your account will be suspended until such material is removed.

4. You must ensure your site is completely legal according to international laws and does not violate any copyright, trademark, or other intellectual property statutes. Any site violating any laws will be deleted instantly without notice.

5. Your entire site must reside on the Casino Riches servers during the term of this agrreement. If you accidently delete your entire site on the server Casino Riches will levy a charge of £100/$150 to re-instate your original site on the server.

6. You may not make use of paragraph, line break, or anchor tags or any other method in an attempt to modify our banners or their hyperlinks. You must not tamper in any way with the display of our advertising banners, text, or graphical buttons or your site will be deleted. However, you may add pages and images to your website and initiate links from the main or other pages you create.

7. You understand that advertising your website via bulk email or spamming, including mass posting to Usenet Newsgroups and abuses of AOLs chatrooms, forums, and buddy system will cause my account to be closed immediately. Any illegal activities will be prosecuted to the full extent of the law.

8. Your site must be written in English or it will be deleted.

9.You may not upload any file size over 75K in total size, however many small files are fine. Any files in violation will be deleted or compressed at our discretion.

10. No mpeg, avi, ra, .exe, zip files may be uploaded.

Terms and conditions

Responsibility for Your Site

1. Casino Riches Clients are welcomed and encouraged to use our Webmaster resources. However, you will be solely responsible for the development, operation, and maintenance of your website and for all additional materials that appear on your site. In addition, you will be solely responsible for ensuring that materials posted on your site are not libellous or otherwise illegal. We disclaim all liability for these matters. Further, you will indemnify and hold us harmless from all claims, damages, and expenses (including, without limitation, attorneys' fees) relating to the development, operation, maintenance, and contents of your site.

Copyright material

2. If you upload copyright material without prior permission your website will be suspended from the public domain until such copyright material is removed.

Maintaining affiliate links

3. You must not remove the link to Absolute Web Design or the banner with "casino cash on line Business opportunity", wrote on it. You agree to fully cooperate with us (Casino Riches) in order to establish and maintain the Links between your website and the 'recommended affiliate links' that we initially blind-post on your website and recommend on the Webmaster Control (unless you elect Casino Riches to post the links *see Server Access above). The maintenance and updating of your website will be your responsibility. The graphics and/or text associated with the Links to the 'recommended affiliate links' will be updated periodically on the Webmasters Control and it will be necessary for you to update the content of your website accordingly on a regular basis. Please be aware that we have the right to monitor your website at any time to determine if you are following the terms and conditions of this Agreement and to notify you of any changes to your website that we feel should be made.

Maintaining Domain names

4. During the first two years, from a date that may pre-date your website going live, Casino Riches agrees to pay for the Clients domain name. Prior to the expiration of the Clients designated domain name the Client will be notified by email. The renewal of the designated domain name will remain Clients responsibility and the Client agrees to pay for the domain name from a prescribed supplier in order to maintain the said website. Casino Riches cannot be held responsible for a domain name, or the continuation of the said website, should a domain name expire prior to the Client making payment. The Client also agrees to maintain their current email address. Should the Clients email address change, and the client fails to notify Casino Riches, Casino Riches cannot be held responsible should the domain name expire and the website does not function. However, Casino Riches may, at its discretion, pay for the domain name and invoice the Client accordingly. The ownership of the Domain name will remain the intellectual property of yourself at all times, who may assign the domain name to another party if the domain fees have not been maintained by the Client.

Maintaining your Server

5. During the first year, from the date that the Clients website goes live, Casino Riches provides server space without additional charge. However, on expiration of the first year the Client agrees to pay Casino Riches an annual server fee of £39.00 UK (or in equivalent currency). If the purchase of the original website was made by credit or debit card the Client agrees that this or any subsequent amount(s) will be automatically debited from the Clients credit or debit card. If the Client has paid by cheque (check) the Client will be sent an invoice via email. Failure to pay the server fee(s) within 30 days from the date of invoice will result in the suspension of the Clients website(s). Casino Riches cannot be held responsible for whatever reason for any server outages or downtime that may result from either hosting or world-wide web interruptions.

Confidential Information

6. During the term of this Agreement (which is open-ended), you may be entrusted with Confidential Information relating to the business, operations, or underlying technology of Casino Riches and/or the recommended affiliate programs (including, for example, affiliate fees earned by you under the programs). You agree to avoid disclosure or unauthorised use of the Confidential Information to any third persons or outside parties unless you have our prior written consent and that you will use the Confidential Information only for purposes necessary to further the purposes of this Agreement. Your obligations with respect to Confidential Information shall survive the termination of this Agreement.

Liabilities and Warranties

7. As a Client of Casino Riches and as Webmaster of your own website, you acknowledge that Casino Riches neither advocates nor endorses the purchase or the use of any services or software offered by non-recommended affiliates or third party website operators or software manufacturers that have not been sanctioned by On-line Gaming Productions. In addition, we cannot guarantee the quality, fitness, or results of any such products, service or compliance with any law or regulation. Casino Riches makes no guarantee or warranty that the Client will achieve a substantial or implied income from their website(s). Although Casino Riches pledge to provide reasonable marketing and technical support during their hours of operation, the ability of the Client to earn income from their website(s) is speculative, and is based on current world-wide Casino industry statistics, therefore the success of a Clients website(s) is dependant upon the Clients efforts in developing and marketing their website(s).

Term and Termination

8. The term of this Agreement will begin once the Client has paid the prescribed fees and the website is made 'live', and will be continuous unless and until either party notifies the other in writing that it wishes to terminate the Agreement, in which case this Agreement may be terminated immediately without refund or any recourse against Casino Riches. Termination is at will, for any reason, by either party. For purposes of notification of termination, delivery via e-mail is considered a written and immediate form of notification.

Upon termination

9a. All rights and licenses given to you in this Agreement shall immediately terminate.

9b. You will return to us any confidential information, and all copies of it in your possession, custody and control and will cease all uses of any trade names, trademarks, service marks, logos and other designations of Casino Riches.

Miscellaneous

10. We may terminate this agreement if we determine (at our sole discretion) that your website becomes unsuitable. Unsuitable sites include those that: are aimed at children, display child pornography or other illegal sexual acts, promote violence, promote discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age, promote illegal activities or violate intellectual property rights.

Assignment

11. You may not assign the website nor this Agreement, by operation of law or otherwise, without our prior written consent. Subject to that restriction, this Agreement will be binding on, inure to the benefit of, and enforceable against you and us and our respective successors and assigns.
